1. About these Terms and Conditions
These Terms and Conditions apply to purchases and services supplied under the Hoof & Habitat name, including pasture seed mixtures, consultancy, online courses, live and recorded webinars, workshops, training sessions and practical demonstrations.
In these Terms and Conditions, “Hoof & Habitat”, “we”, “us” and “our” refer to:
-
Legal business name: Hoof and Habitat Ltd.
-
Trading name: Hoof & Habitat
-
Business address: 30 Holmes Lane, Soham, Ely, CB7 5JP
-
Email: info@hoofandhabitat.co.uk
-
Website: https://hoofandhabitat.co.uk
-
Education platform: https://learn.hoofandhabitat.co.uk
Please read these Terms and Conditions before placing an order or booking a service. By placing an order or making a booking, you agree to the terms that apply to your purchase, subject to any rights you have under applicable law.
Nothing in these Terms and Conditions is intended to exclude or restrict any statutory rights that cannot lawfully be excluded or restricted.
2. Products and services
Hoof & Habitat provides the following products and services:
-
Pasture seed mixtures: seed products supplied within the United Kingdom, subject to the delivery restrictions stated at checkout.
-
Consultancy: remote and in-person advice relating to horse pasture, grazing management, vegetation, trees, land management and equine nutrition.
-
Education and training: online courses, live and recorded webinars, workshops, group training, practical demonstrations and related educational materials.
The specific product or service purchased, its description, price and any additional conditions displayed at the point of sale form part of the agreement between you and us.
Different cancellation, delivery and access arrangements apply to different products and services, as explained below.
3. Information, prices and availability
We aim to ensure that descriptions, photographs, prices, dates, course details and other information on our websites are accurate and up to date.
Prices are displayed in the currency stated at checkout and include any applicable taxes where required by law. Any delivery charges or other compulsory charges will be disclosed before you complete your purchase.
We reserve the right to correct genuine errors and update product listings, prices and availability. A change will not retrospectively alter an order that we have already accepted, except where permitted by law or agreed with you.
If a material error affects an order, we will contact you to explain the issue and discuss an appropriate resolution. If we cannot supply what you ordered, you will be entitled to a refund of any payment made for the undelivered product or service.
PART A — PASTURE SEED PRODUCTS
4. Seed mixtures and composition
Our pasture seed mixtures are designed for the purposes described in their product listings. The stated composition and product information are intended to help you make an informed purchasing decision.
Where a product listing states a species composition or percentage breakdown, we aim to ensure that the information accurately represents the relevant batch or product being offered.
Seed is an agricultural product, and the composition of a mixture may need to change between production batches because of seed availability, crop conditions, supplier changes or other factors.
Where necessary, we may make reasonable changes to species varieties or proportions between batches. We will not knowingly substitute a materially different mixture without providing appropriate information and, where required, obtaining your agreement.
Any statement that a mixture is free from a particular species, such as ryegrass or white clover, applies to the product as described in its listing. Please contact us before ordering if a particular species, variety or compositional characteristic is essential to your requirements.
5. Choosing a suitable seed mixture
Choosing a suitable pasture mixture depends on a range of factors, including soil type, soil pH, drainage, climate, existing vegetation, intended land use, grazing pressure and the management of the pasture.
Product descriptions provide general guidance and are not a guarantee that a mixture will be suitable for every site.
You are responsible for assessing whether a product is appropriate for your land and intended use unless you have separately engaged us to provide consultancy covering that assessment.
If you are unsure which mixture is suitable, please contact us before ordering.
6. Establishment and growing conditions
Seed germination, establishment and long-term pasture performance depend on factors beyond our control, including:
-
Soil condition, fertility, pH and drainage.
-
Weather and seasonal conditions.
-
Seedbed preparation and sowing method.
-
Competition from existing vegetation.
-
Grazing, mowing, trampling and subsequent management.
-
Pests, diseases and other environmental factors.
We cannot guarantee a particular germination rate in your field, establishment outcome, plant composition, yield or long-term pasture condition unless we have expressly agreed a specific guarantee in writing.
This does not affect any statutory rights you have if goods are faulty, not as described or otherwise fail to meet the requirements of applicable law.
7. Pasture suitability and horse safety
No pasture seed mixture can guarantee that a pasture will be safe for every horse or prevent conditions such as equine metabolic problems or laminitis.
Pasture safety depends on more than the species present. Soil, plant growth stage, weather, grazing management, stocking levels, individual horse health and selective grazing behaviour can all be relevant.
Product descriptions and general guidance are not a substitute for veterinary advice or an individual assessment of a horse's needs.
You are responsible for assessing your horses' suitability for grazing a particular area and for obtaining veterinary or other professional advice where appropriate.
8. Orders and payment
Orders may be placed through the sales channels specified on our website or by emailing info@hoofandhabitat.co.uk.
An order is subject to acceptance by us. An automated order acknowledgement confirms that we have received your order but does not necessarily mean that the order has been accepted.
Payment must be made using an accepted payment method displayed at checkout or on an invoice.
If we cannot fulfil an order, we will notify you and refund any payment received for the unfulfilled order.
9. Delivery
Seed products are supplied for delivery within the United Kingdom unless a specific listing expressly states otherwise.
Delivery estimates are provided in good faith and are not guaranteed dates unless expressly stated as such.
We will notify you if we become aware of a significant delay or an issue that prevents us from fulfilling your order.
You must provide an accurate delivery address and any relevant delivery instructions. Please contact us promptly if you identify an error in the details supplied.
Risk in the goods passes to you when you, or a person you have identified to receive the goods, takes physical possession of them, except where applicable law provides otherwise.
If goods are lost, damaged or not delivered, please contact us so that we can investigate and arrange an appropriate remedy where required.
We are not responsible for the loss or damage of goods once they have been passed to a courier.
10. Storage and handling
Seed should be stored in suitable conditions, following any storage instructions supplied with the product.
You are responsible for appropriate storage and handling after delivery. We cannot accept responsibility for deterioration caused by unsuitable storage, contamination, moisture, excessive heat or other conditions arising after risk has passed to you, except where we remain liable under applicable law.
11. Cancelling or returning seed orders
If you are a consumer purchasing online or through another qualifying distance-selling arrangement, you will generally have a statutory right to cancel within 14 days after receiving the goods. Exceptions may apply in specific circumstances under applicable law.
To exercise a right to cancel, you must clearly inform us of your decision within the applicable cancellation period. You may use the cancellation form at the end of these Terms and Conditions, but you do not have to.
Unless we have agreed otherwise, you must return the goods within 14 days after informing us of your decision to cancel. You will generally be responsible for the direct cost of returning goods where we informed you of this before purchase.
You may handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning. We may be entitled to deduct an amount reflecting any loss in value caused by handling beyond what is necessary, where permitted by law.
Because seed is a living agricultural product, opening, contaminating, sowing or otherwise using it may affect its condition and value. This does not remove any statutory cancellation rights that apply, but it may affect the amount refundable where the law permits a deduction.
Where a product is faulty, damaged, not as described or otherwise fails to meet statutory requirements, you may have additional rights to a repair, replacement, price reduction or refund, as applicable.
Nothing in this section limits your rights under the Consumer Rights Act 2015 or other applicable legislation.
PART B — CONSULTANCY
12. Scope of consultancy
Consultancy may be delivered remotely, including through photographs, telephone or online meetings, or in person at an agreed location.
Depending on the service agreed, consultancy may cover:
-
Pasture and grazing management.
-
Soil, vegetation and land condition.
-
Trees, hedges and habitat considerations.
-
Pasture improvement and establishment.
-
Equine nutrition and related management considerations.
The scope of each engagement will depend on the service booked and the information available.
Consultancy does not include laboratory testing, surveying, veterinary diagnosis, legal advice, engineering services, specialist ecological surveys or other services outside the agreed scope.
Where additional work is required, this may be quoted separately.
13. Consultancy fees, travel and payment
Unless a different written quotation has been agreed, our standard consultancy rates are:
-
First three hours: £80 per hour.
-
Additional time after the first three hours: £60 per hour.
-
Travel: 45 pence per mile.
A minimum three-hour charge applies to long-distance trips where this has been specified as part of the booking or quotation.
Mileage and the first hour's fee are payable in advance for applicable in-person consultancy bookings. Any remaining agreed fees and expenses will be payable in accordance with the invoice or quotation.
For remote consultancy, the fee and scope will be confirmed before the work begins.
Any additional work, expenses or changes to the agreed scope will be discussed with you before they are incurred, unless otherwise agreed.
14. Nature and limitations of advice
Our advice is based on our professional knowledge, the information you provide, observations made during any site visit and the scope of the agreed service.
Land and pasture systems are affected by biological, environmental, climatic and management factors. We cannot guarantee a particular outcome, including establishment success, pasture productivity, biodiversity improvements, changes in soil condition or a particular grazing result.
Photographs and remote observations may not reveal all relevant site conditions. Where we have not inspected a site in person, our advice will be limited accordingly.
You are responsible for providing accurate and complete information, disclosing relevant constraints and deciding how to implement recommendations.
You should obtain veterinary advice for animal health concerns and any other specialist advice appropriate to your circumstances. Our consultancy is not a substitute for veterinary diagnosis or treatment.
If circumstances change materially after advice is given, further assessment may be required.
15. Consultancy cancellations and rescheduling
If you need to cancel or reschedule a consultancy appointment, please give at least 48 hours' notice wherever possible.
Where less notice is given, we may seek to recover reasonable costs or retain amounts that we are legally entitled to charge, taking account of work already undertaken, expenses incurred and any applicable statutory cancellation rights. Any cancellation charge will be fair and proportionate to the circumstances.
For consumer bookings made online, by telephone or through another qualifying distance-selling arrangement, statutory cancellation rights may apply. These rights are not removed by the 48-hour notice request.
If you ask us to begin providing a service during a statutory cancellation period, we will obtain any consent or acknowledgement required by law. If you subsequently cancel, you may be required to pay a proportionate amount for services already supplied, where the legal conditions for doing so are met.
If we need to cancel or reschedule, we will offer an alternative appointment or refund any amount paid for the service we cannot provide, as appropriate.
PART C — EDUCATION, COURSES AND EVENTS
16. Educational products and services
Educational products and services may include:
-
Live webinars and online presentations.
-
Recorded webinars and digital learning materials.
-
Online courses.
-
In-person workshops and group training.
-
Practical demonstrations and field-based learning.
-
Other educational sessions described on our websites.
The product listing or booking page will provide relevant information such as content, format, dates, duration, access arrangements, price and any applicable accreditation or continuing professional development (CPD) details.
Where a session is advertised as approved or accredited for CPD, the description will identify the relevant scheme or organisation. Approval or accreditation should not be assumed unless expressly stated. You are responsible for ensuring that your organisation will accept our educational products and services as CPD and for ensuring you obtain sufficient proof of completion of CPD as required by your organisation.
17. Live webinars and recordings
Live webinars take place at the date and time stated in the relevant listing or booking confirmation.
You are responsible for ensuring that you have a suitable internet connection and compatible device to access an online session.
Where a recording is expressly included in the purchase, we will make it available in accordance with the timescale stated in the listing or communicated to participants. If no specific timescale is stated, we will aim to make the recording available as soon as reasonably practicable.
A recording is not guaranteed where it has not been included in the advertised offer or where circumstances beyond our reasonable control prevent it from being produced. If a recording is a material part of the product purchased and we cannot supply it, we will discuss an appropriate remedy, including a refund where required by law.
Unless otherwise stated, a recording is provided for the personal use of the purchaser and must not be shared, copied, republished or distributed without our written permission.
18. Online course and recording access
Where a course or recording is advertised as providing lifetime access, this means that we intend to provide access for the lifetime of the relevant course or recording offering, while the platform, content and necessary hosting arrangements remain available.
Lifetime access does not mean that access can be guaranteed indefinitely regardless of platform closure, technical failure, legal requirements or circumstances outside our reasonable control.
We will take reasonable steps to maintain access and, where reasonably practicable, to give notice of significant planned changes or withdrawal of content.
If we materially withdraw access to paid content earlier than reasonably expected, other than where required by law or due to circumstances outside our reasonable control, we will consider an appropriate remedy in light of the circumstances and your statutory rights.
Access is personal to the purchaser unless a group or organisational licence has been expressly agreed. Login details must not be shared in a way that allows unauthorised access.
19. In-person workshops, training and practical demonstrations
Participants must follow reasonable safety instructions and comply with any site-specific rules communicated before or during an event. All under 18’s must be accompanied by a responsible adult.
You are responsible for wearing appropriate clothing and footwear and for informing us of any relevant access requirements or limitations that may affect your safe participation.
Where an event takes place on agricultural land, pasture or an equestrian site, participants may encounter uneven ground, mud, livestock, horses, machinery, plants, weather-related hazards or other ordinary risks associated with that environment.
We will take reasonable steps to manage risks within our control. Participants must take reasonable care for their own safety and follow instructions given by event organisers.
Unless expressly included in the event, participants must not handle horses, operate machinery or undertake activities requiring specialist supervision or authorisation.
We may make reasonable changes to the location, format, timing or content of an event where necessary for safety, operational reasons or circumstances beyond our reasonable control. If a material change substantially affects what was purchased, we will offer an appropriate solution in accordance with applicable law.
20. Educational content and results
Our educational materials are intended to provide information and support informed decision-making about horse pasture, land management, environmental considerations and related subjects.
They are not a guarantee of a particular result and should not be treated as site-specific consultancy unless that is expressly included in the service purchased.
Examples, case studies and demonstrations illustrate particular situations and may not be directly transferable to every site or horse.
You remain responsible for decisions made and actions taken using educational materials. Where a situation requires individual assessment, specialist advice or veterinary input, you should obtain that advice.
21. Education cancellations, refunds and event changes
Cancellation and refund arrangements depend on the type of product or service purchased and any statutory rights that apply.
Online courses and recorded digital content
For qualifying consumer purchases made at a distance, a statutory 14-day cancellation period will generally apply to digital content that is not supplied on a physical medium.
If you expressly consent to the supply of digital content beginning during that period and acknowledge that you will lose your statutory right to cancel once supply begins, you may lose that right when supply begins, as permitted by law.
We will obtain the relevant consent and acknowledgement where required. Access to content does not, by itself, replace any consent or acknowledgement required by law.
Live webinars and other services
A statutory cancellation period may apply to qualifying consumer bookings made at a distance. If you expressly request that a service begin during that period and later cancel, you may be required to pay a proportionate amount for the service already supplied, where the relevant legal conditions are met.
Any statutory exceptions or loss of cancellation rights will apply only where the legal requirements for the relevant exception or loss of rights are satisfied.
In-person events and workshops
Cancellation rights will depend on the nature of the booking and the applicable law. Certain leisure services provided on a specific date or during a specific period may be exempt from the statutory 14-day cancellation right. Whether an exception applies will depend on the particular service.
Where a statutory cancellation right does not apply, any cancellation terms displayed before booking will apply, provided they are fair and lawful.
If we cancel or materially change an event
If we cancel an event, we will offer a replacement date, an alternative arrangement or a refund as appropriate to the circumstances and any applicable statutory rights.
If you cannot attend an event, please contact us as soon as possible. Any discretionary transfer or refund will depend on the event terms and the circumstances.
PART D — GENERAL TERMS
22. Intellectual property
Unless otherwise stated, the copyright and other intellectual property rights in our website content, course materials, presentations, recordings, photographs, documents, diagrams, handouts and other educational materials belong to Hoof & Habitat or the relevant rights holder.
Purchasing a product, course, recording or consultancy service does not transfer ownership of intellectual property rights to you.
You may use materials supplied to you for your own personal learning or for the purpose expressly agreed with us.
Unless we have given written permission, you must not reproduce, distribute, sell, publish, upload, broadcast, adapt or commercially exploit our materials, or share access to paid digital content, beyond what is permitted by law.
If you wish to use our materials in teaching, training, publications, presentations or commercial activities, please contact us to discuss permission.
23. Customer conduct and access
You must not use our websites, courses or services for unlawful purposes or in a way that infringes the rights of others.
You must not attempt to gain unauthorised access to our systems, interfere with the operation of our websites or learning platforms, or share access credentials in breach of the applicable terms.
We may suspend access or take reasonable steps to protect our services where there is evidence of misuse, unlawful conduct, a security risk or a serious breach of these Terms and Conditions.
Where reasonably possible, we will explain the reason for any suspension and give you an opportunity to address the issue. Any suspension, termination or restriction will be subject to applicable law and will not remove statutory rights to a refund or other remedy where one is due.
24. Liability
Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer, you have statutory rights in relation to goods and services. Nothing in these Terms and Conditions affects those rights.
Where you purchase as a business, we will be responsible for losses that are reasonably foreseeable consequences of our breach of contract or negligence, subject to any lawful and clearly agreed limitations that apply to the particular contract.
We are not responsible for losses arising solely from inaccurate or incomplete information supplied by you, misuse of a product, failure to follow reasonable instructions, or decisions made outside the agreed scope of our services, except to the extent that the loss results from our breach of contract, negligence or other liability for which we remain responsible under applicable law.
We cannot guarantee that our websites, online learning platforms or third-party technology will operate without interruption or error. We will take reasonable steps to address issues within our control.
Nothing in this section removes liability that we owe under applicable law or changes the legal standard of care applicable to our services.
25. Third-party platforms and services
We may use third-party platforms and providers to operate our websites, process payments, deliver online courses, host webinars, communicate with customers and provide other services.
Your use of a third-party platform may also be subject to that provider's own terms and privacy notices.
We are not responsible for independent third-party services to the extent that a problem is outside our control, but this does not remove any responsibility we have for services we have agreed to provide or any statutory rights you may have against us.
26. Privacy and cookies
We process personal information in accordance with our Privacy Policy:
Privacy Policy: https://www.hoofandhabitat.co.uk/privacy-policy
Information about cookies and similar technologies is available here:
Cookie Policy: https://www.hoofandhabitat.co.uk/cookie-policy
Please read these policies to understand how personal information is collected, used and protected.
27. Complaints and contact
If you have a question, concern or complaint about a product or service, please contact us in the first instance.
Email: info@hoofandhabitat.co.uk
Please include your order or booking reference, a description of the issue and any relevant supporting information.
We will aim to acknowledge your complaint within a reasonable time and work with you to resolve it fairly.
Nothing in this section prevents you from exercising any statutory rights or using any legally available complaint or dispute-resolution process.
28. Changes to these Terms and Conditions
We may update these Terms and Conditions from time to time to reflect changes in our business, products, services, platform arrangements or legal obligations.
The version published on our website will show the date it was last updated.
Changes will generally apply to orders and bookings placed after the updated terms are published. Where a change needs to apply to an existing agreement, we will do so only where permitted by law or with your agreement where required.
29. Governing law and jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by the law of England and Wales.
The courts of England and Wales shall have jurisdiction over disputes arising out of or in connection with these Terms and Conditions, subject to any mandatory legal rights or jurisdictional protections that apply to you.
If you are a consumer living in another part of the United Kingdom or another country, this clause does not deprive you of any mandatory consumer protections or rights that the law requires to remain available to you.
30. Standard cancellation form
You may use the following form to notify us that you wish to cancel a contract where you have a statutory right to do so. You do not have to use this form; any clear statement of your decision to cancel will normally be sufficient.
